Regulatory Comparison

Two Regimes, One Direction

EmpCo and the Swiss rule are legally independent instruments, but they land on the same substantive standard: no environmental or climate claim without verifiable evidence.

EU EmpCo Directive

Legal Basis: Consumer protection law (Directive 2024/825).

Directly applicable from 27 September 2026. Bans generic environmental claims and requires third-party verification for sustainability labels.

Swiss UWG Art. 3

Legal Basis: Unfair competition law (Federal Act against Unfair Competition).

In force since 1 January 2025. BAFU enforcement guidance requires concrete, objective, and verifiable proof for climate-related advertising.
